NEW LAW WOULD PROTECT NYS FROM CHECK SCAMMERS
As the holiday season brings an increase in mail and financial pressures, Assemblyman Santabarbara has introduced legislation to ban fake mail documents that mimic real checks.
These documents often feature bank names, "pay to the order of" lines, dollar amounts, perforated edges, and mock account numbers, making them difficult to distinguish from legitimate checks.
The proposed bill would prohibit lenders or companies from sending unsolicited documents that resemble checks to promote loans or financial products.
The FBI and U.S. Postal Inspection Service have reported a rise in mail-based financial scams since 2021. Additionally, the Federal Trade Commission recorded over $12.5 billion in consumer fraud losses in 2024, marking the highest ever reported.
Consumers frequently report receiving mail that appears to be a check or official payment, only to discover it is a disguised loan solicitation.
The legislation would impose penalties of up to $5,000 and allow individuals to recover damages and attorney fees.ca
"No one should be unknowingly pulled into a financial product they never requested," said Santabarbara. "The legislation ends a deceptive practice that takes advantage of people's trust in mail."
